Abstract

Introduction: Penal selectivity is a structural phenomenon that disproportionately affects Black, economically disadvantaged adolescents from peripheral territories within the Brazilian socio-educational system. The intersection of race, class, and territory reveals inequalities that precede the offense and permeate experiences of deprivation of liberty. Objective: To critically analyze the mechanisms of penal selectivity within the Brazilian socio-educational system, considering an intersectional perspective and its relationship with the trajectories of Black adolescents deprived of liberty. Methods: A qualitative, theoretical, and bibliographic study with a critical-analytical approach was conducted. Scientific articles, books, dissertations, theses, institutional documents, legislation, and research reports related to the topic were analyzed through critical content analysis. Results: The findings demonstrated a predominance of Black, male, socioeconomically vulnerable adolescents from peripheral territories in detention units. Mechanisms of racial filtering, territorial criminalization, institutional racism, and the predominance of security-oriented practices over educational dimensions were identified. Conclusion: Penal selectivity results from the intersection of structural inequalities and institutional practices, requiring a socio-educational approach grounded in comprehensive protection, rights protection, and combating racism.
